These Terms & Conditions (“Terms”) govern your use of Thriving Oregon websites and services, including thrivingoregon.com, business.thrivingoregon.com, Ozzi (our Lane County guide), local search, directory browsing, events, and related features (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who we are

2. What the Service provides

Thriving Oregon is a local guide to Lane County. We publish articles, outdoors information, events, business and service listings, and search tools — including Ozzi, an AI-assisted chat guide that helps you explore the site and find local information.

We work hard to keep information accurate and useful, but the Service is provided for general informational purposes. It is not professional advice (legal, medical, financial, safety, or otherwise). Always verify important details — hours, prices, availability, permits, trail conditions, business credentials — directly with the source before you rely on them.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service. By using the Service, you represent that you meet this requirement and have the authority to agree to these Terms.

4. Your account and acceptable use

You agree to use the Service lawfully and respectfully. You will not:

  • Violate any applicable law or regulation
  • Infringe the rights of others, including intellectual property and privacy rights
  • Post or transmit unlawful, harassing, defamatory, obscene, or misleading content
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Scrape, crawl, or harvest data from the Service in a way that burdens our infrastructure or violates these Terms, except where we give written permission or your browser makes ordinary requests to use the site
  • Use automated means to abuse Ozzi, search, or chat features (including spam, flooding, or prompt injection intended to break or manipulate the Service)
  • Misrepresent your identity or affiliation
  • Use the Service to send unsolicited commercial messages or malware

We may suspend or restrict access if we believe you have violated these Terms or pose a risk to the Service or other users.

5. Ozzi, search, and AI-assisted features

Ozzi and our search tools may use automated and artificial-intelligence systems to interpret your questions and return suggestions, listings, articles, or conversational replies.

You understand and agree that:

  • AI-generated responses may be incomplete, outdated, or incorrect
  • Search results are based on our directory, editorial content, and available data — not a guarantee that a business is open, qualified, licensed, or the best fit for your needs
  • Ozzi is a guide, not a human expert, emergency service, or substitute for your own judgment
  • For urgent safety, health, or legal matters, contact appropriate professionals or emergency services — do not rely on Ozzi
  • Your chat messages and search queries may be processed as described in our Privacy Policy, including limited session history and server-side logs
  • You can clear much of your on-device Ozzi/search memory using Start fresh in Ozzi or by clearing cookies and site data in your browser

Optional features that request expanded suggestions from third-party search or AI providers are used only when you choose them; those providers process data under their own terms and policies.

6. Listings, links, and third-party sites

Directory listings, maps, articles, and search results may include links to third-party websites (for example, a business’s own site, Google Maps, or social pages). We do not control and are not responsible for third-party content, products, services, or privacy practices.

Listing a business, trail, event, or article on Thriving Oregon does not constitute our endorsement, guarantee, or agency relationship with that entity. Business information is supplied by public sources, partners, and submissions and may change without notice.

If you believe a listing contains an error, contact us through the Contact page and we will review it.

7. User content and contributions

The Service may allow you to submit or post content — for example, comments, contact form messages, business suggestions, or chat messages (“User Content”).

You retain ownership of your User Content, but you grant Thriving Oregon a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content as needed to operate, promote, and improve the Service. You represent that you have the right to submit your User Content and that it does not violate these Terms or any third-party rights.

We may remove or refuse User Content at our discretion, including content we believe is unlawful, misleading, off-topic, or harmful.

Chat messages sent to Ozzi are used to provide the Service and are not treated as private direct messages to a person. Do not submit sensitive personal information you do not want processed or retained as described in our Privacy Policy.

8. Intellectual property

The Service — including site design, branding, editorial content, databases, software, and compiled listings (excluding third-party marks and materials) — is owned by Thriving Oregon or our licensors and is protected by copyright, trademark, and other laws.

You may view and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from our content or software without prior written permission, except for brief quotations or sharing links in a way that is fair and customary.

“Thriving Oregon,” “Ozzi,” and related logos are our trademarks. Other names and marks belong to their respective owners.

9. DMCA copyright policy

Thriving Oregon respects intellectual property rights and expects users to do the same. If you believe material on the Service infringes your copyright, send a notice that includes:

  1. A physical or electronic signature of a person authorized to act for the copyright owner
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it (URL or specific page)
  4. Your contact information (address, phone, and email)
  5. A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

Send DMCA notices through our Contact page with the subject line DMCA Notice, or by mail to the address in Section 1.

We may remove or disable access to material that we believe infringes copyright and may terminate repeat infringers where appropriate.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, THRIVING OREGON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that listings, search results, or AI responses will be accurate, complete, or current.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THRIVING OREGON AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Thriving Oregon and its team from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms or any law.

13. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. When we change these Terms, we will revise the “Last updated” date at the top of this page. Material changes may also be noted on the site. Your continued use after changes become effective means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. You agree that exclusive jurisdiction for disputes relating to these Terms or the Service lies in the state or federal courts located in Oregon, and you consent to personal jurisdiction there.

Before filing a formal dispute, we encourage you to contact us so we can try to resolve the issue informally.

15. General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Thriving Oregon regarding the Service.
  • Severability. If any provision is unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. We may assign these Terms; you may not assign them without our consent.
